When a sole application for civil partnership dissolution is submitted to the court, a copy of the application will be sent to the respondent. They are required to respond to this within 14 days, acknowledging the application through an ‘acknowledgement of service form’.

Civil partnership dissolution can feel even more challenging if you share children together because there never will be that clean break, especially when you need to juggle living arrangements and contact between yourselves.
Most parents will have a set view on where their children should reside following a dissolution, but it’s important to consider your children’s wishes and to maintain any parent and child relationship.

In some instances, it may be more appropriate to obtain a child arrangement order from the court. The process of ending a civil partnership is the exact same as getting divorced. Both are governed by the Divorce, Dissolution and Separation Act 2020. You can choose to apply for dissolution together as a joint application where both parties will be referred to as joint applicants or a sole application where there will be an applicant and respondent, and this can either be done online.
At a minimum, a civil partnership dissolution takes 26 weeks to finalise, and this is from when the application was submitted to receiving the final order. Once the dissolution application is submitted, there will be what’s known as a cooling-off period which lasts for 20 weeks. After this time has passed, the Conditional Order can be applied for, there will then be a further 6 weeks and one day until the applicant or joint applicants can apply for the Final Order.
Despite this minimum 6 month time period to receive the final order, other aspects which are involved in dissolving your civil partnership can take considerably longer. If you are unable to agree on how finances will be divided or where children will live, you may need to go to court for a decision.
There is only one ground for civil partnership dissolution, and that is that the civil partnership “has broken down irretrievably”. Applicants will need to provide a statement claiming this during the application process.
